Woke up to hearing talk of snow this morning?! Here I am just admiring how brilliant red some of the leaves in the area have been this Fall.

We walked a couple blocks to a bike and walking trail that just opened close to home. It was so pretty there with the turn of leaves and the wooded area that it runs through. The city did a good job expanding its trail to connect to other smaller trails and connect a lot of our parks

Illinois Realtors is spending a significant chunk of funds trying to fight Home Rule in Carbondale, despite local members being in favor of keeping it. We’re getting flooded with mailers.

I have not read the Illinois privacy law. However BNSF recently lost a $228 lawsuit for violating Truck drivers privacy right by using fingerprint key access locks on their Intermodal truck centers. Is this a bad law or a good law?

More astonishing to me is that they didn’t think about legalities before implementation. Or worse, did it anyway.

Got home from the gym and grocery shopping to find that my building’s power had gone out.
That is the reason that I a) live on the 2d floor, and b) have a gas range..

BIPA is a great law.
BNSF contracted out the collection of fingerprint biometrics to a two-person start-up. As the plaintiff’s attorney pointed out, as a 150-year-old company in a highly-regulated industry, BNSF knew or should have known about BIPA.
Moreover, after the lawsuit was filed in 2019, at which point BNSF *definitely* knew about BIPA and that its subcontractor was collecting fingerprints without notice or consent, BNSF *kept collecting the data in exactly the same way*, which probably helped persuade the jury of its reckless disregard for the law.

Oh, PS: the $228 million number is because BIPA allows for $5,000 in statutory damages for reckless or intentional violation of the law. BNSF violated 45,600 individuals’ rights, and is required to pay $5,000 to each.
$228 million is a big number, for sure, but so is 45,600 people having their rights violated, and 45,600 reckless or intentional violations of the law.

Chance of snow near Chicago? We had shovelable snow a few years ago and temps below freezing in October.
BNSF: So they knew of the suit in 2019, but that doesn’t mean they were told they broke the law, so of course they’d keep doing it, in case they could show there was no violation. And if they do, they write it off on Federal taxes (if they even pay any).
3rd mailing regarding fake ‘newspapers’ received over the weekend, but still never received a fake.

BNSF actually did not dispute they broke the law, they just said they shouldn’t be sued for it.

To Suburban Mon ref BNSF: I missed that somehow reading it; that’s pretty funny: “We broke the law, but we shouldn’t be sued over it”. I’m sure that’s gonna work well.

I’ll do my best to keep this within the guidelines promulgated by our charming host and his delightful new intern, so that I can avoid being placed in moderation:
Last Thursday, I was at my job in an Illinois city, working for a corporation chartered in Illinois.
Representative Adam Kinzinger (R, Illinois) and his colleagues were having a hearing that was being broadcast by a public radio station that has its headquarters at an Illinois university.
I was only able to catch bits and pieces of the hearing, between the times I was not helping customers.
Do anyone here know of a url for the House Select Committee Hearing from last week? I would like to watch it from beginning to end, while sitting on the couch in my Illinois living room.

P.S. Rich, Isabel: how’d I do with keeping this in the guidelines?
