*** UPDATED x1 *** After IDPH issues new emergency rules, DeVore urges followers “Bring this state to its knees”

Posted in:

* Mike Miletich

The Illinois Department of Public Health has filed emergency rules to make Gov. J.B. Pritzker’s recent executive order regarding schools less vulnerable to legal challenges.

Most of the language in the IDPH rules is identical to the executive order Pritzker filed late Friday. However, the department deleted any references to “modified quarantine” in previous guidance. That previously allowed students to continue in-person learning after coming in contact with someone who had COVID-19.

Attorney Tom DeVore won several cases stating schools couldn’t put any student under quarantine without a court order.

Attorney Brian Bare says by deleting “modified quarantine”, IDPH is sending a message to the courts that they did not agree with DeVore’s interpretation of their previous regulations.

The new rules clarify that school districts don’t need court action to require testing, masks, or excluding students and school personnel.

“By making it clear that these types of things can happen without a court order or without an order from the county health department, that makes it much easier for schools to continue to operate in accordance with the executive orders and the guidance form the State Board of Education,” Bare said.

The rules are here.

* Tom DeVore blew his stack on Facebook the other night about the new rules

Boy, I got a story for you guys. I don’t usually, I try to keep you guys calm as much as I can, but with what I’m getting ready to tell you right now, you need to be so p*ssed off. I don’t, I don’t even know how to tell you to respond to this. Because what I just printed off. What I just printed off, you guys need to see if you can get about a million people to watch what I’m going to tell you right now. What I just printed off right here is tyranny. By definition this is tyranny. Okay. The courts have been protecting you for the last month, saying that your due process rights cannot be violated under the law. That exclusion from school, makes sense right, exclusion from school, putting mass on your babies, sticking a needle in your damn arm or sticking a swab up your nose, you have a right to that integrity as people… and it can’t be taken away from you without due process of law.

Um, that upends a century of clear judicial rulings on stopping the spread of infectious diseases, but whatever.

* More DeVore

Do you know what these useless b*stards have done, or they’re trying to do, you know what you’re trying to do? The Department of Public Health just created an emergency rule and you didn’t hear about it on TV. You didn’t hear the governor talk about it. They created an emergency rule. And you know what they tried to say that it says, because COVID is an emergency after 19 months. They are trying to by a rule take all of your constitutional due process rights away from you. That’s what these no good, sons of b*tches are trying to do. They have no shame. They ought to all be in prison in my opinion, they ought to be in a federal prison is what they all ought to be in. […]

These tyrants are coming after your kids, they’re coming after them with this bullsh*t. It’s all bullsh*t.

Keep in mind that this man is running for the appellate court.

* “I need you to leave your houses in droves,” DeVore continued

Bring this state to its knees. You have the power to do it because otherwise these dirty son of a b*tches. I’m sorry. I’m cussing now because I’m that mad at this. These people are not going to relent, they are not going to relent unless you make them relent.

Hat tip to a commenter for discussing this rant earlier today.

…Adding… If you’d like a bit more insight into the bizarre nature of this small but vocal faction, watch this video from a Vandalia, Illinois school board meeting

*** UPDATE *** DeVore’s “quarantine” logic has led to at least one arrest

Similar to its last meeting, COVID matters largely took center stage at Monday’s Waterloo School Board meeting.

But this time, the police were called.

After addressing the board stating his discontent with Gov. JB Pritzker’s school mask mandate and Waterloo’s compliance, resident James Link refused to put his mask back on at the meeting.

He was subsequently escorted into a hallway by two Waterloo police officers and arrested for criminal trespass to state supported property, Waterloo Police Chief Jeff Prosise confirmed. […]

When school board member Gary Most told Link he needed to mask up, Link asked Most to present “an order of quarantine,” following up with “You show it to me and I’ll put the mask on.”

  2. This guy comes off like an enraged eighth-grader (I mean no offense to any particular eighth-grader or group of eighth-graders). And he’s an attorney running for a seat on the Appellate Court???
One more reason why I will continue to avoid Facebook like the cesspool it is.

  3. I’m thinking the almost 25,000 deaths are doing a fine job of bringing Illinois to it’s knees.

  4. He’s just mad that this likely stops all of court cases in their tracks. Found out recently he’s charging $5k a case for these school lawsuits. I imagine this’ll slow those cases.

Comment by River Folk Wednesday, Sep 22, 21 @ 10:31 am

  5. DeVore running for Appellate Ct. such an ethical nightmare. Almost makes Rottering who is not a judge and running for the Supreme Ct. look like an angel.

Comment by Amalia Wednesday, Sep 22, 21 @ 10:32 am

  6. Riverfolk,
You mean his “pro bono” consultant work for all the schools is not really pro-bono? Maybe VandySandy can inform Devore that he shouldn’t be profitting off of the virus as she alleges school officials are doing…

Comment by GatewayGopher Wednesday, Sep 22, 21 @ 10:35 am

  7. Isn’t it amazing how what has been normal for controlling the spread of diseases seemingly since we learned the basic science has now become tyranny? I hate to be political on this, but I really blame all of this on the former president who politicized all of this. Thousands of people have died and are dying because of this willful ignorance. I don’t know whether Devore knows better but he should. He’s just a soul-less grifter.

Comment by New Day Wednesday, Sep 22, 21 @ 10:40 am

  8. First… that video… my gosh. I saw it beforehand, what is wrong with people. Not rhetorical or satirical, what is wrong with people.

    To DeVore,

The danger now is the ginning up the lemmings that embrace the falsehoods and want confrontation, while ignoring medical and societal dangers.

The danger DeVore craves is the want to be on the bench to “be a voice” not be a judicial conscience to applying the law.

Can’t beat someone with no one, DeVore wants his chance to overwhelm with his “string minority voice” that could be very well a majority of voters elevating him in their corner of Illinois.

Comment by Oswego Willy Wednesday, Sep 22, 21 @ 10:42 am

  9. Illinois Code of Judicial Conduct Canon 7(A)..(3)

A candidate for a judicial office:

    (a) shall maintain the dignity appropriate to judicial office and act in a manner consistent with the integrity and independence of the judiciary…

    (d) shall not:

    (i) make statements that commit or appear to commit the candidate with respect to cases, controversies or issues within cases that are likely to come before the court…

  10. Maybe it’s me, but I can almost see Devore’s career and reputation coming to some incredibly weird and surreal end.

  13. DeVore’s followers are already doing a bang up job bringing parts of the state to their knees through their ignorance. They can reap the bitter harvest they’re sowing. I’m just simply done caring about the willfully ignorant.

  14. When I saw that video, it reminded me of Cecily Strong on SNL. Then the speaker turned the dial up past 11.
    Very sad.

  15. DeVore’s rhetoric is an incitement to violence.

He’s going to get people hurt or killed.

Sure, he’s just a grifter in it for the money.

But, great danger that using such language inspires the unstable who take him seriously and don’t realize he’s just trying to get paid.

Comment by Moe Berg Wednesday, Sep 22, 21 @ 10:50 am

  16. In order to make a Due Process claim, you have to first show that someone is being deprived of a protected right.

    DeVore cannot do that.

Comment by Thomas Paine Wednesday, Sep 22, 21 @ 10:52 am

  17. “Bring this state to its knees” isn’t that a terrorist threat? Serious question.

Comment by AnonymousFool Wednesday, Sep 22, 21 @ 10:54 am

  18. “although this one leans very much to the evil.”

Yeah, he’s evil. He knows very well that what he’s saying is false. He’s saying it to gin up anger to get more cases. He’s knowingly putting people in danger so he can profit. Pure evil.

As to the video: Nuremberg Codes? Golly I hope she is not registered to vote. I have been taking lots of stuff with a grain of salt but this is scary. What normal person would want to be in a school board now?

Comment by DuPage Saint Wednesday, Sep 22, 21 @ 11:03 am

  23. Not that I think DeVore would go the bar association evaluation route in his run for Appellate Court, but if he does it will certainly make it easier to evaluate him on “Judicial Temperament” - None.

Comment by truthteller Wednesday, Sep 22, 21 @ 11:05 am

  25. -has DeVore done things that could get him in ARDC hot water?-

Not really. Their rules are more in the context of actions representing clients and appearing before judges. For example he couldn’t make such comments about the judiciary but there’s nothing in the rules about the Executive Branch. Closest he gets at this point I would say he gets is saying in his opinion the officials should be locked up. If he has pending civil cases against some of those same agencies he can’t threaten criminal charges to gain advantage under the rules.

Comment by Ron Burgundy Wednesday, Sep 22, 21 @ 11:07 am

  26. The country just passed the death total of the Spanish Flu (unfairly named) pandemic. Yes, the population is larger, but the medical, technological and communications advances made since then more than offset that factor. These deaths and the illnesses are the result of ignorance and malice by a large sector of our society. We will continue to suffer with this pandemic so long as the Devores and the GOP enablers continue.

Comment by Norseman Wednesday, Sep 22, 21 @ 11:09 am

Good. Arrest them all. It’s time to make the consequences for these people as severe as possible.

  28. It will take more arrest and probably filing some liability cases against these people until they wakeup. Let them feel the pain of jail time and public shaming (if that can be done) and paying a price for their actions.

Comment by Give Me A Break Wednesday, Sep 22, 21 @ 11:15 am

  29. The 2020 election shenanigans and now Covid have revealed how distressingly unable lawyers are to police our own ranks. Like, we appear to be even worse at it than actual police asked to police their own ranks.

Comment by Suburban Mom Wednesday, Sep 22, 21 @ 11:19 am

  30. I’ve sat through a lot of school board meetings and people who are not connected to reality speaking at them. That’s about a 9 out of 10 on the scale of how not connected to reality they are.

The problem is people like Devore enable mental illness by playing into conspiracy theories. It’s mostly sad, but the dark humor is probably necessary for me to stay sane through times like this.

  31. Fox News polling showed masks in schools for children and teachers is at 67% positive. Masks containing the virus polling is at 69%. Vaccine safe and effective is at 65%
How much longer are we going to keep allowing loud mouths to play this goofy game. Until they all end up on the Reddit death page?

  32. -The 2020 election shenanigans and now Covid have revealed how distressingly unable lawyers are to police our own ranks.-

Unfortunately, as set up most of the proceedings are drawn out and don’t even start (in the case of abuse of court process) until a court levies sanctions. I would personally like to see more state bars (usually run by the Supreme Court of that state ultimately) issuing interim suspensions to flagrant violators so they can be sidelined and stopped from causing imminent harm while their case is heard. Instead, such suspensions are used to protect the public from people like Blago who wasn’t practicing law anyway.

Comment by Ron Burgundy Wednesday, Sep 22, 21 @ 11:30 am

  33. There ought to be a way to peacefully drum such a person out of public life. He’s like our very own homegrown Josh Hawley character. (Maybe even that sets too high a bar.) The thing is, that kind of social pressure would require a return to widely accepted “norms,” so–yeah, not holding my breath. What a mess.

  46. =Attorney Tom DeVore won several cases stating schools couldn’t put any student under quarantine without a court order.=

First, he has not “won” anything. I heard that lie at our BOE meeting Monday night, right before I was called hitler (I am 1/2 Jewish so that was really cool). He has a few TRO’s. They won’t stand and never will. Devore is a grifter and nothing more. He is mad because his windfall is about done.

As to the speaker at Vandalia- 1st, she is wrong on all accounts. It was just mouth vomit from beginning to end.

I am getting out of this business as soon as I can, can’t hardly take it anymore.

Comment by JS Mill Wednesday, Sep 22, 21 @ 12:31 pm

  47. === This is awesome. ===

Its the definition of Pyrrhic victory.

The judgments in DeVore’s favor in local courts are moot now, you have gained notihng in the long run except ensuring your eventual defeat, and even if by the laws of man you should somehow miraculously prevail, by the laws of nature - whether you believe they were dictated by God or Science - you are eventually doomed.

99.5 percent of the people being killed by COVID right now are The Unvaccinated, how long do you think The Unvaccinated can keep sustaining those losses? Hint: the answer is less than “Forever.”

Comment by Thomas Paine Wednesday, Sep 22, 21 @ 12:32 pm

  48. -The judgments in DeVore’s favor in local courts are moot now-

Yep. He’s mad that they acted to take away what he had “won” and now has to resort to name calling, torches and pitchforks because the legal argument is gone.

Comment by Ron Burgundy Wednesday, Sep 22, 21 @ 12:36 pm

  49. I am a resident of the county that includes the school district shown above in the video. This behavior and non-rational thinking is common here. You see the (expletive) Biden signs hanging on front porches and garages right next to Pritzker s**** signs. Reading Facebook memes and watching You Tube videos makes a person an expert in medicine, finance, budgets, etc. The problem is people like Devore and Bailey are seen as the saviors that are ready to show “those people” who want to take away your rights how things are going to be. Unfortunately Wilhour and Miller represent this area and Bailey and Devore speak and campaign here, so the red meat gets fed to the masses and people get worked up and do what you see above.
