Illinois Gov. JB Pritzker is threatening to withhold federal funds from local law enforcement if they refuse to enforce his executive order.
The Illinois Emergency Management Agency (IEMA) sent a letter to local police officials on May 20th, warning them that federal funding could be withheld from their department. The letter said, “Failure to execute or enforce the [executive order] could be considered noncompliance with the [Public Assistance Program Grant] Agreement condition to comply with all applicable state laws, regulations and policies thus placing the applicant’s funding in jeopardy.” […]
“To threaten any law enforcement agency that they’re not going to give us funding, that’s bully tactics. And I’m not going to be bullied,” said Winnebago County Sheriff Gary Caruana.
Ogle County Sheriff Brian VanVickle added, “It is outrageous that the Governor is threatening retaliation against these leaders and the men and women of their offices. He is insulting heroic police officers, corrections officers and local voters.”
OK, now read the state’s letter. You’ll notice that in order to receive federal disaster funding from the state (which is the grant recipient), local law enforcement agencies must certify they are complying with “all applicable federal and state laws, regulations and policies.” If those agencies claim to be following those laws, regulations and policies and are not, they can lose their funding. And if they’re not obeying Pritzker’s EO, the state contends they could be ruled out of compliance for the grant money.
That’s pretty standard stuff for almost every sort of federal and state grant. Nobody, but nobody is entitled to grant money if they’re not following the rules. Kinda weird that some sheriffs are claiming to be above the sort of law that everyone else has to follow if they want government money.
Also, federal regulations prohibit disaster relief to an applicant for “damage caused by its own negligence.” Reopening in advance could trigger that regulation, the letter states, “if the act of reopening resulted in increased costs for emergency protective measures.”

That boiler plate verbiage will get you every time. Kind of like the terms of service for the internet. Everyone checks the box but doesn’t read the fine print.

… the rest is the realization of what is currently happening, and if you’re drawing a line in the sand here, that’s the hill you will find yourself arguing… maybe against yourself later.
It’s a tough way to go about the business of governing, and keeping it compartmentalized will be… something too.

“Enforcement” can be accomplished in MANY different ways. Not making arrests, as the Governor has suggested, does not mean no enforcement.

I agree with everything Rich says — follow the rules, reap the rewards; break the rules, pay the penalties. If ignorance of the law is no excuse, it’s no excuse for everyone, sheriffs included.
One thing concerns me, however. The Pritzker administration has not always done a good job getting these details in front of people in a way that is direct and easily understood. As is often said on this blog, the public doesn’t do nuance. One of my political mentors told me long ago that if your explanation takes more than two or three sentences, you’ve already lost. Pritzker and his staff aren’t really good at capturing the nub of an issue in a few sentences, but that’s what it will take with issues like this grant money.
I say this as someone much impressed with Pritzker’s performance throughout his time in office.

Everyone is so preachy about these rogue counties but less preachy when it comes to not enforcing the laws under the banner of bail reform or criminal justice reform.

I agree. You can’t pick and choose what rules and laws you follow. Don’t follow the law? Don’t get the money. Pretty simple. Even for politicians and media members.

New York v. United States, 505 U.S. 144 (1992), held the federal government may not enact a regulatory program that “commandeers” the state’s legislative and administrative mechanisms to enforce federal law.

I thought elected officials swore an oath to uphold the state and federal constitution and the law. I never really got that they would only enforce the laws they liked. But if good enough for them should be good enough for everyone. I have a few laws I might not wan to obey

holy moly LCR…what do you not get? A condition of the COVID Federal grant requires all recipients to certify that it abides by all local, state, and federal laws. This is Federal policy, not state.

If the police and the administration are fighting, I, for one, knee jerk support the state administration, not the cops. I wouldn’t trust law enforcement officers to keep me safe as far as I could throw them.

Local sheriffs and states attorneys are making political decisions to not enforce the Governor’s EO. As a result they are putting the public health of their constituents in danger.
I have voted for county republican candidates because I knew of them before this crisis. They have lost my vote in the next election. Until there is a change of heart by any candidate with a “R” behind their name, my vote is going elsewhere.
With regard to the Governor’s popularity, I like him and what he is doing. The republicants, not so much.

Starting under Attorney General Lisa Madigan, the AG’s office started notifying nonprofit organizations that it was withholding state grants from it’s office because said nonprofit had failed to register as required under the Charitable Trust Act with the AG’s office.
Lisa Madigan’s Chief of Staff, Ann Spillane, is now JB’s General Counsel.
Ensuring grantees are following the law isn’t “retaliation,” it is good government.

My money’s on the Gov in a popularity contest. His polling numbers are high, the vast majority of us support a slow opening up. He hasn’t shot any of the people who pay his salary. My experience with police enforcement makes me skeptical that they command more support than the Gov. The Illinois Sheriff’s Association looked ridiculous with their hysterical opposition to legalzing marijuana.
