Notice that she is the one who is responsible for his resignation. Her allegations, not his behavior, are the distraction. Great example of how not to respond to allegations of sexual harassment or revenge porn made against you, esp. when your own friends called on you to resign.

*** UPDATE *** There’s good reason for lawyering up

The [police] report doesn’t describe the photos, but says her former boyfriend asked her to “participate in the acts depicted.”

On July 20, a detective was assigned to investigate but doesn’t appear to have done any follow-up yet, a police source said.

The report is currently listed as a “sex offense-obscenity materials (consisting of lewd writing, pictures, pornographic materials, etc. – with a predominant appeal to prurient interest – not involving children.)”

The report is currently not listed under “non-consensual dissemination of private sexual images (e.g., Revenge Porn,” but the report could be re-assigned a classification when it is further investigated.

Gov. Pat Quinn in 2015 signed legislation making that classification a felony offense. Those convicted of the “revenge porn” law could get one to three years in prison with a fine of up to $25,000.

    Not sure I’d advise a client to use the name of his accuser in the letter of resignation, but at least he didn’t include any photos.

  8. Good Riddance! His problems are only going to escalate after this. Was he trying to intimidate his accuser by naming her? I don’t think she would be after going public.

    Whole mess leaves a “Sauer” taste for politicians.

  26. Exactly to Emily’s point. I’d say this woman has been though a *lot* on account of Sauer (allegedly). We should also take pains to leave her be, if that’s what she wants. She’s done the state a service. I’m sure she just wants her two years back.

    Also, I wouldn’t say this reads lawyerly, so much as what he believes will sound lawyerly and threatening. Great job, tough guy. I’ll second, Jake: Ugh.

  29. Nick Sauer should already be in handcuffs. It’s not just the revenge porn aspect, it’s the credible allegation (according to POLITICO) that he represented himself as her for 2 years online to other men. Really sick.

  30. Precinct Captain–it’s not just policing in Chicago, policing in general doesn’t take this stuff seriously. Stuff like this gets chalked up to “a vengeful ex,” and nothing happens because they “have more important things to do” with their resources.

    According to Rauner, Madigan corrupted Sauer so much that he did this to Ms. Kelly. Between the statements of Rauner and Sauer, you’d think Sauer was just another conservative victim.

  40. To Emily’s tweet, it sounds like he’s denying the actions, or at least not admitting to the acts. If he said “Because of my reprehensible behavior”, if he owned it like she seems to want, just about everything would get at least a little bit worse for him. So I don’t understand her lecture, saying this is a terrible way to respond. If you aren’t going to “plead” guilty to the accusations it’s not too inappropriate. I do think the focus on the girlfriend/the allegations was just weird though; why even acknowledge them? Just say you resign, no reason, or say “personal issues.”
